On 6 July 2023, CMW signed a joint letter led by ClientEarth on enhancing compensation rights against illegal pollution within the Industrial Emissions Directive (IED). It demands the protection of victims suffering from health damage – such as cancer and heart disease – caused by illegal pollution produced by industries that do not stick to environmental rules or authorities that do not act. It calls for establishing a presumption of the causal link between pollution and health damage, if the victim has brought forward sufficient facts. Importantly, the IED currently does not cover greenhouse gas pollution: this is a significant shortcoming in EU climate policy and human rights protection that needs to be addressed by policymakers during the revision of this file.
