Your input to a future appeals procedure against Board decisions – deadline 23 April 2010

During its last meeting, the CDM Executive Board launched a public call for inputs on an appeals procedure to challenge decisions by the CDM Executive Board and DOE performance. This call for input is crucial since it will decide upon the fate of civil society in the appeals procedure.

The call comes as a response to paragraphs 42-43 of Decision 2/CMP.5 that suggests that inter alia “stakeholders directly involved, defined in a conservative manner” can put forward appeals. This is a crucial element which will decide who will ultimately be able to challenge Board decisions. It is important to include civil society at this stage. We have understood that the most favourable definition at this stage would only inlcude stakeholders that have submitted comments during the public commenting process. However, this is not enough. We have also understood that Board members have not yet agreed on the subject of the appeals. Some EB members advocate to limit appeals only to project rejections. We have to raise our voice to create justice in the process so that appeals will be eligible for both, rejections and registrations of project activities.

The input should inter alia address these issues but should also address the overall opportunities/lack for civil society in the process, i.e. lack of input after the validation stage and during registration/review process. Moreover, the input should address the criteria eligible to trigger the appeals process.
